FOLLOWING TERMS AND CONDITIONS GOVERN ALL OF OUR SALES AND
MAY NOT BE CHANGED WITHOUT WRITTEN CONSENT FROM JAMES GASKETS,
INC.
ALL
MANUFACTURER, NAMES, NUMBERS, SYMBOLS AND DESCRIPTIONS ARE
USED FOR REFERENCE PURPOSES ONLY AND DOES NOT IMPLY THAT
ANY PART LISTED IS A PRODUCT OF, OR LICENSED BY, THE HARLEY-DAVIDSON
MOTOR COMPANY.
HOURS
OF OPERATION
Our office hours are 8:00-4:30 p.m. (PST) Monday through
Friday. All visitors must have an appointment.
ORDERING
Telephone orders may be placed during our regular business
hours at 1-800-523-6195 inside the United States or 1-800-523-7843
if calling from outside the United States. Your Customer
Service Representative will read back your order to verify
accuracy. You may fax your order 24 hours a day, seven days
a week at 1-775-246-2235. Domestic orders received by fax
will receive order confirmation and availability by fax.
We reserve the right to accept or reject all or part of
any order.
GENERAL
James Gaskets, Inc. sells only to licensed businesses serving
the general public in the area of motorcycle sales, service
and or parts. All potential dealers must complete a James
Gaskets, Inc. Dealer Application and return it to us for
approval. Once approved you will be assigned a James Gaskets
dealer number and provided with a copy of our dealer price
list. Our minimum order is $50.00 per order within the United
States and $500.00 per order outside the United States.
To maintain an active dealer status, we ask that you purchase
the minimum of $500.00 in product per year.
SHIPPING
For your convenience we offer delivery via UPS and Federal
Express. Please inform your Customer Service Representative
which carrier you prefer when placing your order. For same
day shipping your order must be placed before 12 p.m. (PST).
Orders placed after 12 p.m. (PST) will be shipped the following
business day. All orders will be sent via ground delivery
unless the customer specifies otherwise. UPS and Federal
Express WILL NOT ACCEPT CASH AS PAYMENT FOR PACKAGES.
Customers who have not been check approved must pay by a
certified check or money order.
All
checks and money orders must be payable to James Gaskets,
Inc.
All
orders are shipped by UPS with the exception of international
orders, which are shipped by truck and require prepayment.
Once payment is received we will ship the goods freight
collect. International customers with a UPS account number
may request UPS shipment.

Orders
shipped via UPS Air require additional preparation. Therefore,
we ask that orders be placed by 12 p.m. (PST) for same day
shipping. Orders placed after 12 p.m. (PST) will ship the
following day. James Gaskets, Inc. takes no responsibility
for the arrival and freight charges incurred on air shipments.
James Gaskets, Inc. will not pay or reimburse the freight
costs on any order. Alaska, Hawaii and Puerto Rico are serviced
by UPS Red and Blue Label. International orders are shipped
by the dealer's carrier of choice.
Please
note, freight charges on air delivery are often a high percentage
of the total order. Please plan your orders in time to avoid
the need for Air Services.
NOTE:
Multiple box shipments may get separated during shipment.
If all of the boxes do not arrive on the same day, please
allow 1-2 days for their arrival.
DAMAGED
IN SHIPMENT
James Gaskets, Inc. will not issue credit for merchandise
damaged in transit. Should you receive damaged merchandise
you must comply with the following procedures:
1.
Keep all cartons, packaging and damaged product.
2.
Make a notation on the delivery receipt before the delivering
carrier leaves your premises and retain a copy thereof.
3.
Notify your James Gaskets Customer Service Representative
immediately.
4.
Notify delivering carrier's claims department immediately
to settle your claim. James Gaskets, Inc. will assist you
in providing any documentation required to help settle your
claim.
5.
If there is concealed damage, the delivering carrier must
be notified within 24 hours. Ownership of the merchandise
transfers at the F.O.B. shipping point and all shipments
are fully insured. Therefore, claims for lost or damaged
merchandise must be originated by recipient and are required
to be made to the delivering carrier, not James Gaskets,
Inc. James Gaskets, Inc. must be informed immediately when
a loss or damage claim occurs.
REFUSED
ORDERS
All orders returned to James Gaskets, Inc. by the shipper
will be put back into stock and a 25% restock charge will
be added to the customer's account. Orders returned for
any reason, may result in your account being put on pre-pay
status. You will be responsible for all freight charges
incurred by James Gaskets, Inc. on refused orders.
RETURNED
CHECKS
Returned checks will automatically revert your account status
to certified check or money order for all future orders
unless replaced by cashiers check or money order, or until
the check(s) have cleared the bank. There is a $35.00 charge
on all returned checks. Placing an account back on C.O.D./Company
Check terms will be solely at the discretion of James Gaskets,
Inc. If legal action is used to collect any insufficient
funds, the prevailing party shall be entitled to it's attorney's
fee and costs in addition to any other relief it may receive.
PRICE
CHANGES
The price of products is subject to change without notice.
The price in effect at the time of the order will prevail
regardless of what is printed. Possession of a price list
does not constitute an offer. Should James Gaskets, Inc.
lower the price of any product, James Gaskets, Inc. will
not make any adjustments to any dealer's product inventory
to reflect the new lower price. Your Customer Service Representative
will read back the correct prices when taking an order.
A price increase is not a valid reason for a product return.
RETURN
POLICY
Please refer to the following policies when returning any
item to James Gaskets, Inc.:
1.
Contact your Customer Service Representative to receive
a Return Goods Authorization (RGA) number before returning
any merchandise to James Gaskets, Inc. All returned
merchandise must be accompanied with a copy of your original
invoice. James Gaskets, Inc. reserves the right
to decide between exchange, credit or return of merchandise
after our inspection. The RGA number authorizes the return
of product and does not imply your account will be automatically
credited. No cash refunds will be issued.
2.
Only items listed on your RGA will be accepted for return.
Any other items will be returned at your expense. You
must include copies of your original invoice as proof of
purchase for proper credit. Please write
your RGA number on the outside of the box. James
Gaskets, Inc. will not accept parts damaged in shipping
due to poor packaging. Damaged returned goods will be returned
at your expense. New, saleable merchandise must be returned
within sixty (60) days of invoice. Any parts returned to
James Gaskets incorporated without a RGA number and copies
of the original invoice will be returned to the dealer at
their expense.
3.
A 25% restocking fee will be assessed on all returned merchandise
unless found to be defective or shipped in error. Your Customer
Service Representative will read back your order to verify
accuracy and avoid errors. James Gaskets, Inc. will not
accept returns of non-defective items after sixty (30) days
from the original invoice date. No credit will be
issued for labor costs incurred beyond the original invoice
price of the product.
4.
Shortages or discrepancies must be reported to James Gaskets,
Inc. within 24 hours of delivery. No credit will be issued
unless the correct part is backordered.
5.
Parts must be returned within sixty (30) days from the RGA
issue date. Please send all returned merchandise freight
paid within sixty (30) days to James Gaskets, Inc. for proper
processing.
RETURNS
PROCESSING
If you have any questions regarding the disposition of your
return, please contact your Customer Service Representative.
Credits issued will be posted to your account and will be
offset by future orders. No cash refunds will be issued
for any reason.
WARRANTY
No credit will be issued on any item after it has been installed.
Reworked, altered, or modified merchandise may not be returned
for any reason. All products must be properly installed
by qualified personnel, used in the intended application,
and subjected to normal use. If inspection of the returned
merchandise by our technical staff indicates defects in
materials or workmanship the sole obligation of James Gaskets,
Inc. shall be to replace the product in question. James
Gaskets, Inc. assumes no liability for labor charges incurred
or any other consequential damages.
GENERAL
SALES POLICY
James Gaskets, Inc. reserves the right to add products,
discontinue products, and improve the design of our product
line at any time and without prior notification. Such changes
do not imply obligation for James Gaskets, Inc. to accept
returns based on additions, deletions, or changes. Unless
advised by you in writing within thirty (30) days of issuance
of your dealer number, we will assume that you agree with
the terms and policies stated herein. This document supercedes
any previously issued sales policy. Effective date: September
25, 2000.
